Modesto man to face murder charges

A Stanislaus County Superior Court judge ruled there was enough evidence presented during a preliminary hearing to hold a Modesto man over for trial on murder charges.
Christopher Rabbiosi, 39, is charged with premeditated murder and personally and intentionally discharging a firearm, proximately causing death and will have to face a jury of his peers on those charges. A jury trial date will be scheduled at his arraignment on Jan. 11, 2010.
The case against Rabbiosi arose out of events that occurred on Sept. 19, 2008 in Modesto.
According to the Stanislaus County District Attorney’s Office, Rabbiosi arranged to meet with his former girlfriend, Shawnee Butler, to pay back a debt.
Butler agreed to meet with him and told her husband to expect to hear from her within 30 minutes. After about two hours, Butler’s husband and son grew concerned and went looking for her in the area where Rabbiosi’s mother lived, in the 3900 block of Dragoo Park Drive.
The husband spotted Shawnee Butler and Rabbiosi in her car and as he pulled up to the vehicle, he saw Rabbiosi shoot her in the head, according to the prosecution.
The district attorney’s office contends Rabbiosi then got out of the car and chased the two men, threatening them with the gun.
A resident called 911 and Rabbiosi fled on foot. He later turned himself in and brought the gun with him to the Modesto Police Department.
Butler was kept alive for about a month before she was taken off life-support and pronounced dead.
