Recreation leader in Modesto charged with sexual assault

A 19-year-old man, who worked as an after-school recreation leader in Modesto, has been arrested for sexual assault.

The alleged victim is a 12-year-old girl who took part in an after-school program at James Marshall Elementary School in Modesto, according to the Modesto Police Department.

Vince Gutierrez of Modesto was arrested on multiple sexual assault charges, including unlawful sexual acts with a minor, said Modesto Police Sgt. Rick Armendariz.

The police department was called to the school around 9 a.m. Wednesday after school staff learned the girl had been picked up by a man in a car and had not returned.

When officers arrived at the school they were able to identify the man who picked up the girl as Gutierrez. Gutierrez is a part-time recreational leader for the City of Modesto and a substitute special education instructional para-professional for Modesto City Schools.  The investigation revealed Gutierrez had befriended the 12-year-old victim, while he was working in an after-school program at Marshall School.  Patrol officers located Gutierrez and the 12-year-old victim at his residence, located in the 500 block of Covena Avenue. Officers discovered Gutierrez had engaged in unlawful sexual acts with the 12-year-old, Armendariz said.  Detectives from the Modesto Police Department’s Special Victims Unit are following-up on this case and the investigation is ongoing.
