Attack sends man to prison for 90 years

A Modesto man who turned down a plea deal of 14 years, wound up getting sentenced to three consecutive life terms for a total of 90 years to life for an attack on a Modesto family.
Russell Dominic Miles was convicted of three felony counts of assault with a deadly weapon for his part in a home invasion robbery. Miles has multiple felony convictions that made him fall under California’s Three Strikes law, according to the Stanislaus County District Attorney’s Office. Each felony conviction carried a minimum sentence of 25 years.
The case arose from an attack on a Modesto family. Miles, while  armed with a knife, and two other males entered the victims’ home around 2:30 a.m. on May 28, 2007. Once inside, Miles encountered a man sleeping in the living room and assaulted him with the knife, according to the prosecution. During the struggle, the man suffered a cut to his ear which bled profusely.
He called out for help and his wife rushed to his aid and tried to pry the attacker from her husband. Miles then attacked the wife as well, kicking her and throwing her against a wall. The wife turned again to Miles and tried to repel his attack against her husband by biting Miles hard on his upper arm. Even though Miles was wearing a black sweatshirt, the bite was hard  enough to leave a visible bruise on his skin, the district attorney’s office said.   
While the attack on the husband and wife was taking place in the living room, the other two assailants were attacking the homeowner in his bedroom. After being bitten, Miles fled the residence and the victims, who only speak Lao, were able to get the neighbors to call 911.  
Within seconds of the call, a patrol sergeant apprehended Miles as he tried to ride away from the scene on a bicycle.    
Prior to the start of his jury trial, Miles was offered a plea deal that would have had him serve 14 years, but he turned the offer down, according to the district attorney’s office.
