An armed Turlock man was arrested for burglary after he was caught with his arms full of stolen property inside a residence Monday morning.

The suspect, identified as Nicholas Martinez Sr., 42, was booked for burglary and being a felon in possession of a loaded firearm. Martinez also was on parole for rape and was wearing an ankle monitor at the time of his arrest, said Turlock Police spokesperson Officer Mayra Lewis.

During his arrest, the firearm Martinez allegedly had in his possession fell, causing a round to be ejected, Lewis said.

The Turlock Police Department was alerted to the burglary-in-progress shortly before 8:30 a.m. by a 17-year-old girl house-sitting at the residence.

Lewis said the girl was leaving the home in the 1300 block of E. Tuolumne Road when she saw a man open a side gate.

The girl called a relative, who in turn called 911, Lewis said.

When officers arrived they saw a bike near a back gate and a back door that had been kicked in.

The officers entered the home and found Martinez with his arms full of stolen goods.

According to the police report, Martinez saw the officers and took off running for the front door. In his attempt to escape Martinez slipped and fell to the ground, causing the firearm to fall to the floor and eject one round, Lewis said.

A short struggle ensued between the officers and Martinez when he tried to reach into his waistband. The officers gained control of the suspect and placed him under arrest.

Martinez has an arraignment scheduled for Wednesday.
