More charges for Turlock man accused of sexually abusing minors

A Turlock man who had previously been accused of sexually abusing minors has been re-arrested and charged with new offenses after more victims came forward.

Elton Boyd Kelley, 62, is currently in custody at the Stanislaus County Jail for multiple sex offense charges stemming back to 2003, according to the criminal complaint filed against him by the Stanislaus County District Attorney’s Office.

Kelley is facing one count of continuous sexual abuse of a child, oral copulation of an unconscious person, sending harmful matter with the intent of seducing a minor, and sodomy by force, according to the criminal complaint.

Kelley was initially arrested in February 2015 after an alleged victim went to the Turlock Police Department in December 2014 with sexual abuse claims at the hands of Kelley. He was booked on suspicion of sodomy of a minor, where the victim is prevented from resisting by an intoxicating or anesthetic substance, or any controlled substance; oral copulation of a minor under 14 years; sending harmful matter to a minor; and maintaining a place for unlawfully selling, giving, or using narcotics.

The district attorney’s office was waiting on computer forensics to be completed before filing charges. In the meantime, investigators found potentially more victims and the older charges were combined with the new offenses.

Count one of the criminal complaint alleges Kelley continually sexually abused a boy from December 2003 to December 2010. At the time the abuse started the boy was 13 years old and was either residing in Kelley’s home or Kelley had recurring access to him, according to the criminal complaint. Count one also has a special allegation that the statute of limitations be extended because the crime was committed when the victim was a minor and the victim has not yet reached the age of 28 years.

Count two of the criminal complaint accuses Kelley of felony oral copulation of an unconscious person. The complaint states the offense occurred between April 2010 and April 2012 and that the victim was a 14-year-old boy.

Count three of the criminal complaint alleges Kelley sent harmful matter to a 14-year-old boy between April 2010 to April 2012 with the intent of seducing the minor.

The fourth count in the criminal complaint accuses Kelley of forcible sodomy on a 17-year-old boy. The offense allegedly occurred in September 2013.

Count one and four of the criminal complaint both carry an enhancement that makes Kelley eligible for a life sentence should he be convicted on those charges.

When Kelley was first arrested in February 2015, investigators served a search warrant at his home in the 400 block of Sue Street in Turlock and removed electronic equipment and a computer.

Kelley is being held in custody in lieu of a $525,000 bail. He has a pretrial hearing set for 8:30 a.m. Wednesday.
