Repeat sex offender headed to prison

A Turlock man has been convicted of committing sexual assault on two minors over the course of several years is expected to be sentenced to 12 years in prison.

Elton Boyd Kelley, 64, was convicted of continuous sexual abuse of a child for crimes against John Doe 1, and oral copulation of a minor for crimes against John Doe 2.

Kelley’s jury trial in Stanislaus County Superior Court had seen several days of testimony and evidence presented by the prosecution, when Kelley suddenly decided to change his plea from not guilty to no contest, according to the Stanislaus County District Attorney’s Office.

The sexual assault on John Doe 1 occurred between 2003 and 2010, starting when the boy was 7 and ended when he moved away with his family at age 13. After the family moved to another state, the young boy told his father about the sexual assaults he had suffered at the hands of Kelley and the father contacted the Turlock Police Department.

Kelley was initially arrested in February 2015. At the time of his arrest, investigators served a search warrant at his home in the 400 block of Sue Street in Turlock and removed electronic equipment and a computer.

The district attorney’s office was waiting on computer forensics to be completed before filing charges. In the meantime, investigators found the second victim.

After John Doe 1 moved away, Kelley turned his attention to John Doe 2, sexually assaulting him between 2011 and 2013, when the victim was 15 to 17 years old.

Kelley was initially charged with one count of continuous sexual abuse of a child, oral copulation of an unconscious person, sending harmful matter with the intent of seducing a minor and sodomy by force. In exchange for changing his plea, the district attorney’s office agreed to drop the other charges.

Stanislaus County Superior Court Judge Thomas Zeff found Kelley guilty of the two offenses and ordered he be held at the Stanislaus County Jail without bail.

At sentencing hearing is scheduled for Dec. 12, at which time Kelley is expected to be sentenced to an agreed upon term of 12 years in state prison.

Kelley also will receive one strike and will have to serve at least 85 percent of his sentence.

Upon his release from prison, Kelley will be placed on parole for 20 years and six months and will have to register as a sex offender for the rest of his life.
