Man shot by federal agents near Patterson indicted on assault, property destruction charges

PATTERSON — A man wounded during an encounter with federal immigration agents near Patterson last month has been indicted on charges of assaulting federal officers and destroying government property, federal prosecutors said Friday.

A federal grand jury on Thursday returned a three‑count indictment against 36‑year‑old Carlos Ivan Mendoza Hernandez. He is charged with two counts of assault on a federal officer with a deadly weapon and one count of destruction of government property.

Hernandez’s attorney, Patrick Kolasinski, said the indictment was anticipated and marks the case’s transition into the next stage of federal proceedings.

“We are not going to be commenting in any detail on the facts in the case at this time, as we’re now in open litigation,” Kolasinski said in a statement to CBS News. He added that the defense believes Hernandez will ultimately be cleared. A preliminary hearing previously set for May 5 has been vacated, and a status hearing is now scheduled for May 4.

The charges stem from an April 7 incident near Interstate 5, where federal prosecutors said immigration officers attempted to arrest Hernandez, alleging he was in the country illegally. U.S. Immigration and Customs Enforcement has claimed Hernandez is a member of the 18th Street gang and wanted in El Salvador.

Kolasinski has disputed those assertions, pointing to court documents showing Hernandez was found not guilty of simple homicide in El Salvador in 2019.

Federal officials have not released additional details about the shooting, including how many agents fired or the extent of Hernandez’s injuries.
