District Attorney Jeff Laugero announced that Brandy Lee Rose Devine, 38, of Turlock was denied parole following a parole hearing held at the Central California Women’s Facility in Chowchilla.
Devine is serving a 15-years to life sentence after being convicted of 2nd degree murder following the 2012 death of her two-year old daughter, Stephanie.
The death of 2-year-old Stepanie occurred due to severe neglect. Stephanie had Cerebral Palsy and was severely disabled. In July 2012, Devine put Stephanie in her crib and closed the bedroom door. After putting her in the crib, Devine failed to check on the child, provide food, or give prescription medication to her for the next three days. During this time, Devine used methamphetamine. The child died after 3 days of being locked in the room without any care. Detectives observed that the baby’s clothes were soiled from urine and feces. Although almost three years old, the child weighed only 14 pounds. An autopsy ruled the cause of death to be from acute dehydration and starvation.
Prosecutor Neumann argued for continued confinement based on the danger Devine represents to the community should she be released given her failure to tell the truth, the callous circumstances of her crime, and her lack of insight into what caused her to intentionally put her two-year old baby in a room to die.
The Board of Parole found Devine still posed an unreasonable risk to public safety and denied parole for five years. She will be scheduled for another hearing in 2030, although she may petition the Board of Parole for an earlier date.
Devine has been in prison for approximately eleven years.
Deputy District Attorney Amy Elliott Neumann appeared on behalf of the People and argued against release.
